Law and Economics of LIBOR Manipulation: An Update: Recent decisions by U.S. federal courts have substantially limited the kinds of legal and economic claims that can be pursued in connection with certain financial institutions’ alleged manipulation of the London Interbank Offered Rate (LIBOR). This CLE summarizes the results of the LIBOR litigation to date and discusses methods for investigating damages under claims potentially still permitted by the courts.
Termination of Interest Rate Swaps: This CLE provides legal practitioners with an introduction to interest rate swaps (the most commonly used derivative instruments) and their valuation. These derivative instruments are used to illustrate the challenges related to determining termination payments using the Market Quotation and Loss methods prescribed in the 1992 ISDA Master Agreement.
The Use of WTP and CBC in Patent Damages: In recent consumer product cases, FSG has undertaken analysis of patent damages relying on WTP and CBC measures. This CLE discusses the what, how and who behind WTP-based measures of patent damages and how to make use of and defend against such methods in the course of patent litigation.
