- Assessed stock and future earn out damages associated with claims of fraud and misrepresentations related to an acquisition of consumer car care products.
- Calculated damages resulting from the withholding of restricted securities in association with an acquisition of a Phase I/Phase II biotechnology firm.
- Engaged to calculate personal injury damages due to a small business owner as a result of an automobile accident.
- Retained by counsel in a multi-year assignment on behalf of an international grain trading company in class action litigation involving an alleged corner in the soybean markets. Also retained in a related regulatory investigation. Work involved complex data reconstruction of thousands of multi-legged spot, forward, futures, options, and CIF/FOB market transactions. Client prevailed against charges in regulatory investigations; class actions settled favorably.
- Assisted a U.S. commodity trading company in a $150 million IRS audit involving the tax treatment of future and options hedges. Work involved recreating certain modeling/trading strategies of thousands of transactions. Client settled for an advantageous amount.
- Assisted an international grain company and its broker/dealer subsidiary on a multi-year assignment pertaining to multidistrict litigation involving the alleged arbitrage of government securities, repurchase agreements, and commodity and financial futures. Reconstructed trading records and created databases to test hypotheses of fictitious, fraudulent, prearranged, and tax-motivated trading on customer accounts. Assisted in settlement discussions with hundreds of clients. In first trial of MDL, jury awarded approximately $140 million in favor of client. Other related matters subsequently resolved favorably by client.
- Retained by finance arm of automobile manufacturer to support discovery and expert reports pertaining to claims of alleged lending discrimination by its dealer network. Work included construction of an analytical dataset to support the statistical analysis of tens of thousands of financing applications and transactions.
- Assisted the trust department of a diversified financial institution in litigation involving the run of a real-estate fund. Modeled effects of participants’ net asset values under various redemption scenarios and assisted audit team in developing appropriate financial statement disclosures. Financial institution resolved matter for favorable amount.
- Retained by counsel of a trading and clearing exchange in response to an enforcement action against its internal audit division. Advised on sufficiency of audit procedures performed on futures commission merchants given regulatory requirements. Matter settled favorably with regulators. Later retained to advise audit department on methods to improve execution on future audits.
- Retained by international accounting firm in its defense of an audit of a broker/dealer which engaged in alleged sham government securities transactions that conferred tax losses on clients. Work involved analysis of trading transactions, re-estimation of tax liabilities and analysis of damages.
- Assisted outside counsel of an investment bank in the production of millions of documents related to a massive governmental investigation of insider trading pertaining to junk bonds.
- Retained by financial institution to perform investigation of a futures commission merchant to test compliance with certain debt covenants. Subsequently retained to perform a high-level business diagnostics review of the FCM to identify opportunities to enhance revenue and reduce costs.
- Assisted counsel in multi-year assignment defending an international trading company in its regulatory reporting of cash and futures positions with the CFTC.
- Derivation of the internal rate of return (IRR) in a dispute over the carried interest in a niche real property operator.
- Calculated the true (effective) rate of interest in a case of alleged usury.
- Calculated the internal rate of return in a private equity investment with apparent multiple returns.
