Accounting
- Assessed damages due to a large airplane engine manufacturer as a result of faulty equipment produced by a sub-contractor.
- Assessed transactions in support of $1 billion plus damage claim related to natural gas trading and marketing venture. Also, performed accounting and business record fact-finding relative to specific transactions in dispute and disclosures contained in annual report.
- Assessed damages claim in a breach of contract case involving two parking services companies.
- Retained by counsel of a trading and clearing exchange in response to an enforcement action against its internal audit division. Advised on sufficiency of audit procedures performed on futures commission merchants given regulatory requirements. Matter settled favorably with regulators. Later retained to advise audit department on methods to improve execution on future audits.
- Retained by international accounting firm in its defense of an audit of a broker/dealer which engaged in alleged sham government securities transactions that conferred tax losses on clients. Work involved analysis of trading transactions, re-estimation of tax liabilities and analysis of damages.
- Assisted counsel in multi-year assignment defending an international trading company in its regulatory reporting of cash and futures positions with the CFTC.
- Advised prominent university on compliance with the Governmental Accounting Standards Board reporting and disclosure requirements for derivative investments in its endowment funds.
- Assisted outside counsel of an investment bank in the production of millions of documents related to a massive governmental investigation of insider trading pertaining to junk bonds.
- Provided litigation advisory services (strategic and budgetary) to international accounting firm on complex criminal and civil litigation involving the demise of a real estate limited partnership. In this multi-year assignment, advised on disclosures involving forward looking financial statements, performed reviews of audit work papers, prepared alternative valuation models, performed damage analysis, coordinated the efforts of 20 law firms, experts and consultant teams, and assisted in settlement negotiations with arbitrators. Matter resolved for favorable amount. Additionally saved client and insurer approximately $10,000,000 in legal and consulting fees over three year period.
- Advised counsel in the defense of international accounting firm regarding its audit of a college and its alleged unauthorized trading in mortgage-backed security strips. Performed analysis on the investment portfolio, the investment policies and internal controls, and the related audit procedures. Matter resolved favorably for client.
- Advised international accounting firm on processes to identify causation trends and other patterns in audit failures giving rise to litigation risks.
- Partner-in-charge responsibilities for the defense of certain high-exposure litigation and investigation matters of an international accounting firm. Responsibilities included investigative role or strategic advisory role, depending on the matter.
- Represented a major software development company in defense against a claim for damages related to a licensing agreement for thesaurus and spell check software.
- Acted as a defense liability expert in numerous cases relating to accountant’s malpractice.
- Represented a state pension fund in an action against the management, board and auditors of an enterprise that engaged in massive financial fraud.
- Represented the owners of a company that sold their enterprise to an international language recognition software company for equity shares. The acquirer went into liquidation because of a major financial fraud that was discovered a few months after the sale. Acted as liability expert in separate actions against an international accounting firm and bank.
- Verified the transcription of mortgage information and the methodology used to calculate damages in a class action brought on behalf of mortgagors to recover overcharges of interest under the Truth in Lending Act.
- Retained by directors to compute damages in two actions involving disputes with preeminent entertainers related to their failure to perform as contracted in the legitimate theater.
- Determined damages for an events promoter in a contract dispute with a major sports figure.
- Acted as an expert on damages for a group of major sports agents in a dispute arising out of their changing agencies.
- Numerous cases involving issues on accounting related to post-acquisition disputes.
- Performed an analysis for an international construction company on alleged damages suffered by a hotel developer in a dispute involving project delays.
- Acted as a liability expert on accounting issues for a major international oil and gas company in a dispute concerning joint venture costs with a middle eastern government’s industrial development company.
